If you can get some photos of the manhole in question, and prove it was at fault, make a claim against the Highways!

In our area they don't give a **** quite frankly, and I reported no end of dangerous holes, in excess of 40 mm deep and some over a foot square. They did nothing about them, so I rang up, and said if they didn't do something, I'd be making a claim for damage to my vehicle. They asked what had happened, I told them nothing yet, but it WILL, and I'll be claiming! Next day, road marked with paint around the holes, another day or two, holes bodged up and filled!

According to the bloke I spoke to, a defect in our area must be 40 mm deep before they'll do anything. What a joke. So at the time of inspection, if reported, it was 39 mm, they'd leave it, and if reported again, they would return in a months time! So in that time, it's continued to break up very quickly and you could lose a herd of elephants down it, especially in the winter when the wet gets in it and frost won't help either.

As a motorist who gets robbed blind from all angles, you shouldn't be expected to foot the bill for damage to your car from a defect in the road chap. Worth a try.

Yeh, well said Pete.

Many years ago, my first 340 had a coming together with a well dodgy kerb stone. A tree's roots had caused it to stick out into the road, I had to steer left to avoid a woman who'd turned into the road a bit too quickly and it took out both of my nearside wheels and tyres.

I reported it to the council and sent photographs and a copy of the bill for the work, but they wouldn't take any responsibility. They declared that they had checked the road within the past year and they had found no problems.

As far as I know it is in an even worse state now, even though they've had about seven years to get it repaired.

LOL! Well, I like to fight for what is right and especially where anyone with authority is involved, as often they think they can shrug off any problems by playing on the fact they are in a postion of power and that you are a mere member of the public. Anyone who gets above their station and makes simple excuses and expect you to swallow it needs putting back in their place! In this example, we pay their wages, we pay the road fund licence and get robbed with tax on fuel, so I expect a useable and safe road surface!

Gavin, I'd say that the council are skating on thin ice there. From my understanding, if a complaint is made or their attention is drawn to an unsafe or dangerous area of road, they should at very least inspect it. Then, once someone has assessed it, they are then taking responsibility for the fact that it meets their requirements and doesn't pose a danger. Due to the fact an accident has happened, or in the case of your incident damage was caused, then it's a clear sign something is wrong. Should something happen in the future as a result of that defect, they've been alerted to it, and they've failed to act on it to make it safe.

I've yet to update my complaint to our local Highways. They stuck a load of tarmac ontop of the road (should've been mending potholes with it instead!) to make a load of speed bumps through the village. One of the things has been breaking up for well over a year on the sides, and you must drive though the potholes, which are huge and no matter how slowly you go rattle the hell out of you! I reported it in February, and some clown seemed to think they were ok. Well, since then, they've only got worse. Do we need to have a lorry fall down it before something gets done? It can't be doing much good to my new tyres or newly rebuilt front suspension! I still believe my broken front n/s top spring seat wasn't helped by the speed bumps anyway.

Anyway, good luck Nick, they'll try to wriggle out of it, the normal method might be to claim you weren't paying attention and driving with enough care to spot them, and driving too fast to take action to avoid them. Tell them to get stuffed! You shouldn't be trying to spot dangerous things like this!

sm53 I'd never looked at it like that before. We're plagued with the things around here too, they're a menace. No, don't get me started...

I checked this morning and they have repaired the dodgy kerb stone, although I know it was still in a poor state for a good few years.

Nick; I hope you get a satisfactory result from the council.

Nick, where abouts are you then, as I'm lumbered with what appear to be muppets from Buckinghamshire District Council too! Can't be all that far away!

Believe it or not, since my post yesterday, drove over the bumps to notice some yellow markings, drove over them early afternoon, new tarmac in the holes and bodged up, still uneven and it's bound to sink, but, it's a step in the right direction!

As for having 'go kart wheels,' as you say, the size equates to somewhere near stock, just wider........ for safety say! More grip! Anyway, if it's declared to insurance, you're insured. that's no reason for them to have any involvement in that aspect of things. What if it was a motorcyclist that hit it, because they've only got two wheels it's their fault!? Nah, give them hell, I often do!
