Dont know if yoyu guys remember Swindon Viking ,( hes the guy who gave me his redline ) well I received this email from him yesterday,

Hello Mick

I am still embroiled in an argument with DVLA re transfer of the Volvo.
They are taking me to Court!
They say that they have no record of the letter you sent them. Do you still have the letter they sent you back,acknowledging
your original letter?
Anyway it seems that I needed to inform them myself and your letter was unacceptable as a method of informing them.
Yet they are still mentioning that they have no record of it so I'm thinking that maybe it could be a defendable case if i can show the county court your acknowledgment letter?
also as far as DVLA are concerned I am still registered keeper!!! so whwnI phone them I will ask them what i need to do re staus of vehicle now it's scrapped. The Irony is that I have now found the V5 for the Volvo (i had it in my vary efficient filing system all the time!) I think that i will have to confirm it is scrapped or something or evenfill out your details as the person I transferred to.
What a cock up eh?

Luckily I have still got the new keeper supplement of the V5 with the stamp clerical vehicles on it from DVLA.
plus my original letter telling them that the car was scrapped before the tax disc was refunded ( stamped by them with the date 19/04/05 )
and there reply to me ( dated 22/04/05 )

Obviously I will send this all to Steve.

so even though they know where the car was and what happened to it right up until the tax disc was refunded they still want to take Steve to court

This just gos to show how low the Government are prepared to go to make a couple of quid,

For gods sake please remember .

1) if you sell your car you must fill in the V5 and send it off , do not give it to the purchaser to do , just give them the new keeper supplement .( In this case Steve did not have the V5 )

2) If you scrap a car send the V5 to the Dvla clearly marked that it has been scrapped (preferably in blood)

and 3 ) If your car is off the road remember to register it as SORN and remember to renew the SORN certificate each year as Dvla do not normally send reminders out .

Thats a bit of a bugger ent it!!! I know the first thing i did with my Blueline was to register it SORN sent that in the same envelope as the V5!!!!

IMO the DVLA are a complete bunch of muppets, I know of at least 8 seperate cases of muppetry and cock ups this year made by them! There we were Mick thinking Steve was being so good, letting you keep the tax until you got home, so everything was done above board and legally, then they turn round and try and take him to court!

Indeed, they don't bother sending out reminders for SORN forms, if your car is already declared SORN, for me, this is a nightmare, too many cars I know, but it must be easy money for them, as people will forget to renew them. But, if you've registered it SORN, and you've not gone and taxed it to use it, in theory it is still unused in a SORN state, and sending a form off isn't going to stop any illegal activities, so why bother each year!

Then Adam, be careful sending off the V5 with the SORN form, as the super efficient, up to date, technologically advanced DVLA system cannot cope with the date of ownership transfer and the SORN declaration being on the same day! So in actual fact they want you to have an untaxed car, that is not declared SORN for a day in your ownership so their system can cope!

It's been in the news that they've been messing up driving licences too. So for example people entitled to drive HGV's and have been for donkeys years go to renew their licence to the new photocard ones etc, get sent a new one after submitting their old one, and end up with no entitlement for HGV's, but are fully entitled to drive tanks or motorbikes or something silly! They have then in most cases been made to pay for all of the tests again in order to gain the correct categories of entitlement, as the DVLA shred all information submitted to them after four weeks or something like that.

Recently I was sent a fine for supposedly not declaring a car SORN, which puzzled me, as I had sent two SORN forms together. So why did I have one fine and not two? Their phone system wasn't working for most of the day and when I finally got through in that department, they weren't allowed to access the details of the other vehicle, but could tell me I didn't have a fine. Indeed, it wasn't declared SORN after I spoke to another department, but their system hasn't sent me a fine. So they let me off when I could produce photocopies of the forms, and that they were sent together, so must have been lost in the post. Ok, that's not the DVLA's fault, but their system is still not working properly if some poeple would get away with it and others wouldn't.

Since my they attempted to fine my Dad before the new laws even came into effect, another that the DVLA finally put down to being lost in the post, we photocopy all the forms before sending them, as it's happened far too often, and they really don't like letting you off of that fine, and the arrears they like to slap ontop.

Anywho, rant over, but they apparently have a huge percentage of incorrect records, of ownership, licencing, SORN's, the lot. Basically something needs to be done with their system, as it's not working, as so many cases have shown.

Steve, stick to your guns, if Mick has a letter of confirmation and the V5 new keepers supplement then there shoudl be no way they can prosecute. Good luck and keep us informed, as what these places expect is that people will be scared of the large official enforcement acengy and will pay up without a fight, as I know, you've done nothing wrong, don't let them win!

Well I creat a job for someone when I drop off my 40+ sorn forms every year. I've become very fast at filling them in. But saying that They do not want to know about my Austin that only has a green log book.

I did think about you as I wrote that Dai, (I have now got down off of my ranting soap box, but the DVLA do annoy me!) and all of those cars you have. Indeed, I cannot remember the year now, but cars declared SORN before a certain date don't need to be reregistered each year. I've been meaning to test the DVLA's new online system for declaring SORN, as that'll remove the problem or excuse of lost in the post! I'm sure something will go wrong with that!

I've used the lost in the post one a few times now and got away with it. The 25 year rule should have stayed it would make my life much simpler.
And yes I do HATE them
