I am looking for some free legal advice?

Post by AUTOMAN »

I need a little bit of legal advice (NOT CRIMINAL).

If anybody knows where I can get a little, please could they point me in the right direction? I have tried CAB, but they could not answer my question. I don't have loads of dosh to flash to a solicitor, so if you know of a website, or you are a practitioner of law who would not mind just answering a question, please would you get in touch?

Thanks a lot,

Ian.

You could always get the V3M Geordie mafia to menace them with a large pastie. I hear they're a pretty frightening lot.

Sorry I don't have more constructive advice...

Is the issue something that you can discuss on the site? Understand that it could be a personal matter that you do not want everyone knowing about.

You never know someone here may have had an experiance of something similar.

What I need to know is this. If somebody is holding something that belongs to me against my will, is there a way that I can swear an affor david (Please excuse my spelling), in front of a judge or solicitor with proof that the item does belong to me so that I can just go and re-posess the item whithout having to go to the trouble and expence of using the County Court system?

Getting the boys to go round is a last resort, but thanks for the suggestion anyway.

Hi,

Mrs W16 works as a Legal Adviser for Legal Aid over here in Oz, this is what she says.

You could ask a solicitor to write a letter of demand stating that the item in question is yours - and you have evidence to prove this, and that if you don't get it back then you will go through the court and start legal proceeding against them. This isn't legally enforcable though - and it will cost you the solicitors time though, CAB or UK LegalAid won't usually fund cases like this.

It looks like you will have to go through the courts on this one - or send the heavies round.....

Sorry can't be much more help.

The word is Affidavit

Various options. You could report it to the Police as a theft, but then you may need to show them proof that the item does belong to you if the other party is disputing ownership. Depending on the kind of copper you get, a quiet word from them to the other party may be enough to resolve the case there and then. Of course the policeperson in question may be totally unhelpful, which is probably more likely. Worth a bash though.

Another option is just to take it back, and let them take legal action on you if they feel inclined and then defend it. Or you could take them to court. BTW, I'm not an expert.
